NOTICE Pursuant to Paragraph 2(2) of Schedule 5A of the Housing Act 1985 ("the Act")

INITIAL DEMOLITION NOTICE


TAKE NOTICE THAT:

Intention to Demolish
We, Linc-Cymru Housing Association Limited of 387 Newport Road Cardiff, CF24 1GG give you formal notice pursuant to paragraph 11 of Schedule 5A of the Act of our intention to demolish 1 Church Street, Newport, NP20 2BY; 2 Church Street, Newport, NP20 2BY; 36 Clarence Street, Newport, NP20 2DA and 37 Clarence Street, Newport, NP20 2DA ("the Premises").

Reasons for Demolition
We intend to demolish the Premises because we intend to redevelop the area of Constables Close,
Newport and the properties form an integral part of the proposed reconfiguration.


Demolition Period
We intend to demolish the Premises by no later than 18 March 2022.


Operation and Expiry of this Notice
This Notice will remain in force until 18 March 2022, unless revoked or terminated or extended in accordance with the Act.


Effect of this Notice
Whilst this Notice is in force, we are not under any obligation to transfer the freehold or grant a lease of any dwelling house included in the Premises under Section 138(1) of the Act in respect of any claim to exercise the right to acquire.

This Notice does not prevent you from making a claim to exercise the right to acquire or to take any steps in respect of any existing claim up to the point where section 138(1) would otherwise operate in relation to that claim or the operation of that provision in most circumstances where the notice ceases to be in force.

If we subsequently serve a final demolition notice in respect of the Premises, the right to acquire will not arise and any existing claim will cease to be effective.


Right to Compensation
The Housing Act 1985, Section 138 confers a right of compensation in respect of certain expenditure including legal and other fees and other professional costs and expenses paid to you in connection with the exercise by you of the right to acquire.

We will reimburse your costs and expenses as mentioned above if within three months from receipt of this notice you write to us at Linc-Cymru Housing Association Limited, 387 Newport Road, Cardiff, CF24 1GG (marking your letter for the attention of Carol Tough) claiming an amount of compensation and enclosing receipts or other documents showing that you have incurred the expenditure.

Notes

  • Part V of the Housing Act 1985 applies to claims for the Right to Acquire made under Section 16 of the Housing Act 1996 by virtue of The Housing (Right to Acquire) Regulations 1997.
  • The Right to Acquire has ceased to exist in Wales since 26 January 2019 as a result of the Abolition of the Right to Buy and Associated Rights (Wales) Act 2018.
